This privacy and cookie policy (the “Privacy & Cookie Policy”) of TERRITORY Influence Gmbh, Winzererstr. 47d-e, D-80797 Munich, a company registered at the Local Court [Amtsgericht – AG] of Munich under company registration number HRB 226897 (“trnd”) and of the group companies affiliated with trnd (the “trnd Group Companies”) applies to your
- Registration as a member of the trnd community;
- Use of the trnd community online platform at www.trnd.com, including any subpages relevant to the trnd community (the “trnd Platform”), and of the information, applications and services offered on this platform (the “Services”); and
- Application for and participation in campaigns and projects offered to you by trnd or trnd Group Companies to enable you to test and rate products (the “trnd Projects”) of participating businesses (the “Campaign Partners“).
The trnd Platform and the trnd community are operated by trnd as data controller, and trnd is responsible for any collection, processing and use of your personal data in this context.
As a rule, however, trnd Projects are not run by trnd itself but by the trnd Group Companies in charge on local level of the trnd Projects concerned. These companies are responsible as data controller for collecting, processing and using your data in connection with your participation in a trnd Project.
To facilitate your participation in the relevant trnd Projects, trnd will make the personal data collected from you available to the trnd Group Company responsible for the trnd Project concerned. In return, trnd will receive data about you from the trnd Group Company concerned to the extent that such data are relevant to your membership of the trnd community and your future participation in trnd Projects. A list of current trnd Group Companies is available here.
In the following sections, this Privacy & Cookie Policy informs you about what personal data trnd and/or the trnd Group Companies collect about you and how these data are processed and used.
This Privacy & Cookie Policy does not apply to any subpages at www.trnd.com, such as our company website at http://company.trnd.com, which are not intended for members of the trnd community and which have their own privacy policy.
Rights of data subjects: You have the right to object to this type of data processing at any time. To exercise this right, please delete your trnd account in your profile settings. Cookies and tracking can be disabled by you directly here in the privacy policy. A detailed description of your rights under GDPR can be found in Part 3, Section 3 of this Privacy Policy.
Information on other data processing
As a company, we process personal data in various processes. In order to provide you as the data subject with as much detailed information as possible for these processing purposes, we have compiled this information for the following processing activities and thus fulfil the statutory information requirements pursuant to Art. 12-14 GDPR:

Part 1: TERRITORY Influence GmbH as data controller responsible for the collection, processing and use of your personal data relating to your use of the trnd Platform
The trnd Platform and the trnd community are operated by trnd as data controller. In the following sections, we will inform you about what personal data trnd collects, processes and uses about you when you use the trnd Platform and whether and when those data are disclosed to trnd Group Companies and, if applicable, any third parties.
The legal basis for this data processing is the fulfilment of the service requested by you (Art. 6 Para. 1(b) GDPR) in accordance with our terms of use and participation agreed with you.
The legal basis for trnd passing on your personal data to trnd Group Companies and, if applicable, to third parties is Art. 6 Para. 1(f) GDPR. We have a legitimate interest in sharing your information for internal administrative purposes, in particular to provide our services and carry out joint trnd projects. You have the right to object to this type of data processing at any time. To exercise this right, please delete your trnd account in your profile settings.
1. Visiting the public area of the trnd Platform
You may visit the public area of the trnd Platform without revealing any information about yourself. In this case, trnd collects only access data which do not allow any conclusions as to your identity (more details about the use of cookies for web analysis purposes see below clause 7 of this Privacy & Cookie Policy). These non-personally identifiable data are analysed by trnd to improve its offering and Services. Unless you are logged in as a member of the trnd community to the member area, trnd will collect personal data about you only if you voluntarily decide to disclose such data while visiting the trnd Platform. For instance, it will be necessary that you submit personal data to trnd (e.g. your name and email address) to be able to use certain features and Services (e.g. our contact form).
Any personal data trnd receives from you during your visit to the public area of the trnd Platform will be used only to provide you with the desired features or Services.
For instance, if you make an enquiry through our general contact form, your name and email address and the content of your enquiry will only be used to answer your enquiry. If necessary to answer your enquiry, e.g. if your enquiry concerns a specific trnd Project run locally by a trnd Group Company, trnd will forward your enquiry (and all data associated with it) to the trnd Group Company responsible for dealing with your enquiry.
Your data will not be used for any other purposes. Unless expressly permitted or required by applicable law, or as indicated otherwise in this Privacy & Cookie Policy, we will neither disclose your personal data to any third parties without your consent nor process your data beyond the scope of this Privacy & Cookie Policy.
2. Registration as a member of the trnd community
In order to use the trnd Platform and the Services, and to take part in trnd Projects, you need to register on the trnd-Platform as a member of the trnd community and to create a user account (the “trnd Account”).
For this purpose, you have to provide us with certain information about you (this information may vary depending on the country from where you register to become a member of the trnd community), e.g.:
- your full name
- your email address
- details of your residential address (e.g. place, country, post code or district, if applicable),
- a nickname of your choice (the “User Name”)
- a password of your choice
- your gender
- your date of birth
We need this mandatory information
- to be able to register you as member of the trnd community
- to be able to contact you with regard to participation in suitable trnd Projects based on the information you provided and, if applicable, to select you to participate
- to be able to manage your participation in trnd Projects (e.g. to send you test products or project documentation and to be able to communicate with you about them)
- to be able to communicate with you in connection with your membership of the trnd community
Once you have submitted your registration request, you will receive an email from trnd to verify your email address and activate your trnd Account. To complete your registration, please follow the instructions in this email.
3. Use of the trnd Platform and the Services
If you are registered as a member of the trnd community and logged in with your login details, you can use the following Services.
a. Participation in surveys
As a member of the trnd community, you can participate in current surveys on general topics (e.g. your interests, your job and education or family and home) and on project-specific topics, which we usually develop in cooperation with a Campaign Partner.
Participation in those surveys is voluntary. The more surveys you complete, the better we can understand what you are interested in and which trnd Projects suit you.
If your views or interests change, you can also subsequently make changes to your answers on most of the general topics.
The information you provide us in surveys on general topics will be stored with your profile and will be used by us only to be able to even better select you, based on the information you provided, for potential participation in specific trnd Projects and to send you invitations for this purpose. In no event will your answers be disclosed to third parties in personally identifiable form, except if expressly requested by you or where you have given your consent. However, we may analyse your answers to surveys on general topics for statistical purposes, and surrender them to third parties, in anonymised form (which does not allow any conclusions as to your identity).
Project-specific surveys are usually run in cooperation with our Campaign Partners. We disclose the answers on project-specific surveys to the Campaign Partner responsible for the project concerned in anonymised and aggregated form only. Also in this case, we make sure that no conclusions as to your identity can be drawn. trnd will store your answers on project-specific surveys permanently with your profile only if they are relevant for your future selection for trnd Projects.
b. Comments
As a member of the trnd community, you may leave comments on posts (e.g. blog posts, reports on toptrnds, posts on project pages, etc.) on various pages of the trnd Platform.
If you leave a comment on a post, your comment, your chosen User Name and the time when you submitted your comment (time and date) will be visible to all visitors to the trnd Platform. No other information will be publicly displayed or can be viewed by others, unless you share such information yourself, e.g. as part of your comment.
Comments are voluntary and governed by the trnd Terms of Use and Participation.
Comments you post will not be pre-checked by trnd and may be read by others without your knowledge. Apart from that, other users may comment on any of your comments and post their comments as well.
trnd will make efforts to ensure that the rules for commenting on posts as laid down in the Terms of Use and Participation are complied with and delete any comments not following these rules as soon as trnd becomes aware of them.
Your comments will be retained by trnd as long as the post you commented on will appear on the trnd Platform. For this period of time, your comments will be publicly available. All comments and related information (such as email addresses) will be deleted after such period of time, unless relevant limitation periods applicable to the content of the comments require a longer storage of the comments.
c. Contact reports/photos/other content
As part of your use of the trnd Platform, specifically your participation in trnd Projects, you may submit to trnd and publish different types of content, such as contact reports, comments, reports, images, audio and video files or other contributions (the “Content”).
Except with respect to comments, you may at your own discretion choose whether you want the Content you submit to trnd to be only for internal information of the trnd staff (in which case trnd and the trnd Group Companies will use your Content only for internal evaluation of the trnd Projects carried out and of your activities), or whether you want to share the Content to be public (in which case other visitors to the trnd Platform will be able to see your Content, too).
All Content you share to be public may be published by trnd on www.trnd.com (including any subpages, such as, for instance, the company website at http://company.trnd.com or any country-specific Internet presences of the trnd Platform) and thus be made visible to all other visitors. In this case, the Content you shared to be public and, as the case may be, the date and time of submission and/or the User Name chosen by you will be displayed. No other information will be publicly displayed or can be viewed by others, unless you share such information yourself (e.g. as part of a caption of an image you uploaded).
Your Content will be retained by trnd for as long as the trnd Project concerned, in the context of which your Content was published, will appear on the trnd Platform. For this period of time, your Content will be publicly available. All Content and related information will be deleted after such period of time, unless relevant limitation periods applicable to the Content require a longer storage of the Content. You may request for justified reasons (e.g. in case of termination of your membership of the trnd community) that trnd delete the Content you published.
Moreover, trnd may make Content you shared to be public available to the Campaign Partner whose products you tested in the trnd Project concerned to inform the latter about the progress of the project, e.g. as part of result presentations. In this case, the Campaign Partner will only receive the Content you shared and, as the case may be, the User Name chosen by you. Only with your explicit consent will we share any other information, such as your real name. Therefore, you should make sure at all times that your User Name is not the same as your real name. The Campaign Partner may use the Content you shared only for its internal evaluation of the trnd Project concerned and may not publish the same or use it for any other purposes without your consent.
When sharing your Content, you may further be offered to optionally consent that
(i) trnd may use the Content you shared (including your chosen User Name) in any form (e.g. in printed material, such as flyers, trade fair banners and brochures, or in digital form, such as email newsletters, presentations, online banners, etc.) to advertise the trnd community and trnd’s offering;
and/or
(ii) trnd may disclose the Content you shared (including your chosen User Name) to the Campaign Partner whose products you tested in the trnd Project concerned for the latter to use your Content to advertise the products you tested in any form (e.g. in printed material, such as flyers and brochures, or in digital form, such as email newsletters, presentations, online banners, etc.).
No other information will be published or disclosed. In particular, trnd will never without your consent publish your real name and/or disclose it to the Campaign Partner.
Your consent to the use described above is voluntary and you may withdraw it at any time by sending a respective request to the contact information provided under Part 2, clause 3.. You may access the wording of the consent declarations you have made, if any, at any time by sending a respective request to the contact information provided under Part 2, clause 3.
When submitting Content, please also consider our Terms of Use and Participation. Those terms state the rules for the submission of Content and the scope of the rights of use you grant trnd in Content you submit to trnd and share to be public.
d. Help contact form
As a member of the trnd community, you can communicate with us using the help contact form in your member area. Depending on the type of assistance you need, you will be required to enter the following information:
- project name
- type of problem
- your operating system
- your browser
- your question or comment to trnd
If necessary to answer your enquiry, trnd will forward your enquiry (and all data associated with it) to the trnd Group Company responsible for the trnd Project concerned.
trnd and/or the trnd Group Company responsible for the trnd Project concerned will use your data only to answer your enquiry. Your data will not be used for any other purposes and, unless otherwise stated in this Privacy & Cookie Policy, will not be disclosed to any third parties without your consent, except as expressly required or permitted by law.
4. Application for and participation in trnd Projects
As a member of the trnd community, you can apply for participation in trnd Projects via the trnd Platform and – if you are selected for participation in a trnd Project in accordance with the Terms of Use and Participation – get to know and rate new products in the specific trnd Project.
Generally, each trnd Project is open to a limited number of members only who must meet certain criteria defined for the respective target group of the trnd Project concerned. Therefore, you will be able to apply for a trnd Project only if you have received an invitation (an “application ticket”) to apply for a specific trnd Project. For details of the application process and on participation in trnd Projects, please refer to our Terms of Use and Participation.
a. Disclosure of your data to trnd Group Companies
As a rule, trnd Projects are not run by trnd itself but by the trnd Group Company locally in charge of the trnd Project concerned. To facilitate your application for and participation in trnd Projects, personal data will be exchanged between trnd and the trnd Group Company responsible for the trnd Project concerned. For details about this, please refer to Part 2 below.
b. Application process
When you apply for participation in a specific trnd Project, you may be asked to answer further questions specific to that particular project, e.g. about your interests, existing knowledge and experience relevant to the product to be tested. This information will be used by trnd and/or the trnd Group Company responsible for the trnd Project concerned to review your application and to identify which applicants are best suited to participate in the trnd Project concerned. Moreover, we may disclose your data in anonymised form to the Campaign Partner whose products are to be tested in the trnd Project to inform the Campaign Partner about the potential group of participants and allow the Campaign Partner to participate in the selection of suitable participants. No conclusions as to your identity can be drawn in this context. trnd will store your answers on project-specific surveys permanently with your profile only if they are relevant for your future selection for trnd Projects.
In no event will we disclose your data to the Campaign Partner or third parties in identifiable form, except where you have given your consent. Your personal data will not be used for any other purposes. However, we may re-evaluate the data we have stored about you at a later point and make them available to other Campaign Partners in anonymised form.
c. Participation in trnd Projects
As participant in a specific trnd Project, you will normally be invited to take part in project-specific surveys through the trnd Platform and to let us know about your experience and opinion of the product. Participation in those surveys is voluntary. If you take part in surveys, this may, however, be taken into consideration for your WOM Activity Index and stored for this purpose (see clause 5 below). trnd will store your answers on project-specific surveys permanently with your profile only if this information is relevant for your future selection for trnd Projects.
trnd and/or the trnd Group Company responsible for the trnd Project concerned will forward the results of those surveys in anonymised form to the Campaign Partner whose products you tested in the trnd Project concerned to inform the latter about the progress of the project and provide an understanding of how participants rate the Campaign Partner's products. Moreover, we may re-evaluate the survey results we have stored about you at a later point and make them available to other Campaign Partners in anonymised form.
No conclusions as to your identity can be drawn in this context. In no event will we disclose your personal data to a Campaign Partner or third parties, except where you have given your consent. The personal data collected from you will not be used for any other purposes.
5. WOM activity index/Wombats
Based on your WOM activities, we derive an index that shows us how active you are as a member of the trnd community (hereinafter referred to as the “WOM Activity Index”).
Different types of (offline or online) activities may have an influence on your WOM Activity Index, e.g. discussions you have had with your friends and family in the context of a trnd Project and the contact reports submitted about them, your use of the comment features, your participation in project-specific surveys or assistance with market research through interviews with friends and acquaintances based on the market research documents provided for the trnd Project.
We will store your WOM Activity Index (and – to the extent required for calculating and updating the index – the underlying activities) to be able to take it into account when selecting the participants for future trnd Projects. The WOM Activity Index can be one of many factors in selecting the potential participants for a particular trnd Project. Apart from that, we use this information in anonymised form (which does not allow any conclusions as to your identity) to perform statistical analyses and get a better understanding of our members.
The activities you engage in may also have an impact on the award of “Wombats”. Wombats are trnd rewards which show how active you are as a member of the trnd community. For details of the award of Wombats, please refer to our Terms of Use and Participation. Your Wombats are not visible to other members.
6. Cookies
Like most companies, trnd uses cookies on the trnd Platform. Cookies are small text files sent by a web server to your browser and stored on your device. Except for Google Analytics tracking cookies (for more details see below clause 7 and 10 of this Privacy & Cookie Policy), all cookies trnd uses will be deleted as soon as your browser session is ended (“Session Cookies”). trnd uses Session Cookies only to enable you to use the features of the website. We currently use the following session cookie:
Most browsers are set to accept cookies automatically. However, you can change your browser settings so as to be notified when cookies are being sent, decide on a case-by-case basis whether to accept or decline cookies or exclude them altogether. However, in this case, you may not be able to make full use of some areas or features of the trnd Platform.
The legal basis for the use of session cookies is the provision of the service requested by you (Art. 6 para. 1 (b) GDPR).
Furthermore, we use so-called tracking cookies (e.g. clause 10 Google Analytics). We process the usage information collected in order to analyze and statistically record the use of our services. In this way we would like to improve our offer.
The legal basis for this is Art. 6 para. 1 (f) GDPR. The legitimate interest pursued by us is the improvement and optimization of our services and our products and services, from which our users also benefit.
7. Vimeo
The trnd Platform embeds videos from Vimeo.com, a service of Vimeo, LLC (“Vimeo”). If you access a video through Vimeo, a connection is made to Vimeo’s servers in the US. During this process, certain information is transmitted to Vimeo. Vimeo may also place cookies on your terminal. Moreover, Vimeo provides some additional features such as rating or sharing videos. To be able to use those features, you may need to log on using your Vimeo account or an account you may have with certain third-party providers (e.g. Facebook or Twitter) to enable them to match the information you submit with your respective user account. These features are offered by Vimeo and the relevant third-party providers only, and you should read their privacy policies carefully before using them. trnd will not be informed about the content of the data collected by Vimeo or any third-party provider and has no control over their use.

8. YouTube
The trnd Platform also embeds videos provided by YouTube LLC (“YouTube”). Using YouTube’s offering requires a connection to be established to YouTube’s servers in the US. During this process, certain information is transmitted to YouTube. For all YouTube videos embedded in the trnd Platform, we have enabled the Privacy-enhanced mode offered by YouTube. This means that YouTube stores information about a visitor to our trnd Platform only if he or she chooses to play an embedded video. If this is the case, YouTube may also store cookies on the visitor’s device. trnd does not have control over the collection and storage of information by YouTube and will not be informed about the information collected. You should read YouTube’s Privacy Policy carefully before you decide to use any YouTube features.

9. Google Analytics
This trnd platform uses Google Analytics, a web analytics service provided by Google Inc. (following: Google). Google Analytics uses "cookies", which are text files placed on your device, to help the website analyze how users use the site. The information generated by the cookie about your use of this platform is usually transferred to a Google server in the USA and stored there. However, due to the activation of IP anonymization on this platform, your IP address will be cut back by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of trnd, Google will use this information to evaluate your use of the website, to compile reports on the platform activities and to provide the website operator with further services associated with the use of the website and the Internet. The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data.
You may refuse the use of cookies by selecting the appropriate settings on your browser. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available under the following link:
Browser add-on to disable Google Analytics
In addition, or as an alternative to the browser add-on, you can prevent tracking by Google Analytics on this platform by clicking on this link. An opt-out cookie will be installed on your device. This will prevent Google Analytics from collecting data for this platform and this browser in the future as long as the cookie remains installed in your browser.
This trnd Platform uses the following cookies for Google Analytics
- “_ga” cookie is used to distinguish visitors and expires after 2 years
- “_gat” cookie is used to is used to throttle request rate and expires after 10 minutes
- “ga-disable-” cookie is used to opt-out of tracking and expires 31.12.2099
Part 2: trnd Group Companies as data controllers responsible for the collection, processing and use of your personal data
1. Role of trnd Group Companies
As a rule, trnd Projects are not run by trnd itself but by the trnd Group Company locally in charge of the trnd Project concerned. Therefore, it is not trnd but the respective trnd Group Company who is responsible for the collection, processing and use of your personal data in dealing with your application for and participation in trnd Projects. This may also apply to project-specific surveys run via the trnd Platform because in this case, trnd only acts as infrastructure service provider for the trnd Group Company concerned.
trnd Projects relevant to you will, as a rule, be run by the trnd Group Company being responsible for the country you live in. In exceptional cases, however, there may be trnd Projects which are run by a trnd Group Company across multiple countries. A current list of all trnd Group Companies is available here. When you are invited to a specific trnd Project, you will be informed about who is responsible for running that particular project and for the collection, processing and use of your personal data in that context.
2. Exchange of personal data between trnd and trnd Group Companies
To facilitate your application for and participation in trnd Projects, personal data will be continuously shared between trnd and the trnd Group Company responsible for the trnd Project concerned.
To allow the trnd Group Companies to select and invite the potential participants for a specific trnd Project and to handle the application process and your participation in a trnd Project, trnd will make all personal data stored about you available to the trnd Group Company responsible for the trnd Project concerned.
In return, trnd may receive personal data about you which the trnd Group Company concerned collects from you during your participation in trnd Projects, including, without limitation, your participation in surveys, to the extent that such data are relevant to your membership of the trnd community and your continued participation in trnd Projects. These data will be stored by trnd to be able to take them into account in your future selection as participant for further trnd Projects.
The legal basis for trnd passing on your personal data to trnd Group Companies and, if applicable, to third parties is Art. 6 Para. 1 (f) GDPR. We have a legitimate interest in sharing your information for internal administrative purposes, in particular to provide our services and carry out joint trnd Projects. 3. Running of trnd Projects
All information the trnd Group Company concerned receives from you or from trnd will be used only to carry out the trnd Projects with you, including, without limitation, to invite you to participate in suitable trnd Projects, to process your applications and handle your participation, and to communicate with you about particular trnd Projects and the trnd community.
Your personal data will not be used for any other purposes and not disclosed to third parties, unless the disclosure is required by law.
However, the trnd Group Company may disclose the information collected from you to our Campaign Partners in anonymised form, which does not allow any conclusions as to your identity (see Part 1, clause 4 above).
The legal basis for trnd passing on your personal data to trnd Group Companies and, if applicable, to third parties is Art. 6 Para. 1 (f) GDPR. We have a legitimate interest in sharing your information for internal administrative purposes, in particular to provide our services and carry out joint trnd Projects. You have the right to object to this type of data processing at any time. To exercise this right, please delete your trnd Account in your profile settings.
Part 3: Other general provisions
1. Disclosure of your data
Unless otherwise described in this Privacy & Cookie Policy, trnd and the trnd Group Companies will not transfer or otherwise disclose your information to any third party without your express consent, unless specifically permitted or required by law.
In order to operate the trnd platform and provide related services, trnd uses service providers ("processors" such as hosting or logistics). These service providers are granted access to your data only to the extent and for the period necessary to provide the service in question. Contractual agreements on order processing ensure that the service providers process your data only in accordance with instructions and in compliance with data protection standards. If the service providers process your data outside the European Union (including only access possibilities), this may result in your data being transferred to a country that does not guarantee the same data protection standards as the European Union ("transfer to third countries"). In this case, in accordance with the requirements of the GDPR, we will ensure by contract or otherwise that the service provider guarantees an equivalent standard of data protection law (e.g. through the conclusion of EU standard contractual clauses, EU Commission decision for safe third countries). If and to the extent that the cookies of the trnd platform are also used with the involvement of service providers, the contractual agreements on order processing also apply here. The same applies to a possible transfer to a third country.
2. Security of your data
trnd and the trnd Group Companies have appropriate technical and organisational security measures in place to prevent your personal data from any unauthorized access, use, destruction, alteration or loss.
trnd and the trnd Group Companies will disclose personal data only to those employees who need to know such information in order to provide the trnd Platform and the associated Services and features, and to facilitate your participation in trnd Projects.
3. Your rights / How to contact us
As per the provisions of applicable law, you have the right to access and request information about the personal data trnd and/or the trnd Group Companies have collected from and stored about you and the right to have those data updated, rectified, transferred or cancelled or to object to its processing.
You are further free to withdraw at any time, with effect for the future, any consent you may have given with respect to the processing of your personal data.

- Right to information: You have the right to obtain confirmation from us whether or not we process your personal data, and you have the right to obtain information about your personal data stored by us at any time.
